Products Liability

Products liability may result from equipment malfunction, improper product design, unsafe drugs or lack of product safety. It is the responsibility of every manufacturer to ensure that their products are reasonably safe and effective for their intended and foreseeable uses. A product that is unsafe when used as intended is defective. As a result the manufacturer may be held strictly liable in tort for any injuries caused to the consumer arising from the use of that product. In addition, a product is required to meet all applicable state and federal regulatory requirements promulgated by government agencies for the protection of the consumer.
