Inadequate Security

Inadequate security cases generally involve a breach of security at a commercial establishment or at an apartment complex, which results in injury or death. Oftentimes catastrophic injures, such as rape and murder, result form failure to provide adequate security to an individual. Inadequate security cases often require the injured plaintiff to prove that the business owner or proprietor knew, or had reason to know, that prior criminal activity was common in the area, and was therefore foreseeable to the owner. Whether the owner has actual or constructive knowledge of a potential danger to his business invitees (who are often tenants), the owner has a duty to exercise reasonable care to prevent the happening of that same occurrence to others, or to warn of the dangers or the risk of danger associated with the premises. When the owner breaches the duty to take adequate measures to safeguard or warn the victim, through such means as providing security patrols, lighting, proper maintenance of doors and window locks, and the use of alarm systems, then the victim may possibly be entitled to compensation for his or her injuries.
